“X Factor” U.K. boy band One Direction has settled a lawsuit over the rights to the band’s name. The American rock band that also called itself One Direction has now changed its name to Uncharted Shores, according to a press release announcing the settlement.
Back in February 2012, I first reported that One Direction was headed toward a legal battle over the rights to use the name One Direction. Other media outlets then picked up the story. Sure enough, the American band calling itself One Direction sued “The X Factor” U.K. band in June 2012. The “X Factor” U.K. band then countersued the American band.
Just as I predicted in my initial report, an out of-court settlement was reached and the American band changed its name. What this means is that the American band was probably paid a certain amount of money to change its name as part of the settlement agreement, which will probably remain confidential.
The five members of One Direction are 18-year-old Harry Styles, 19-year-old Zayn Malik, 18-year-old Niall Horan, 20-year-old Louis Tomlinson and 19-year-old Liam Payne. They all originally auditioned for “The X Factor” U.K. as solo singers, but they were rejected as solo singers and allowed to continue in the competition on the condition that they form a group created by Cowell and other “X Factor” decision makers. That group, which was formed in July 2010, was named One Direction. One Direction has said in several interviews that it was Styles’ idea to name the group One Direction. Cowell was One Direction’s mentor when he was a judge on the show.
“The X Factor” U.K.’s One Direction came in third place on the show in 2010. Since then, the group has released its debut album, “Up All Night,” which became a No. 1 hit in several countries and so far has sold 3 million copies worldwide, according to Sony Music. One Direction has also had sold-out tours in many countries. “Up All Night” has sold 1 million copies so far in the U.S., and is 2012’s top-selling debut album in the U.S. and other countries.
The American band formerly known as One Direction is based in California and began performing in public as One Direction in 2009, according to the lawsuit. The group doesn’t have a major record deal. In February 2011, the band released an album titled “The Light” on independent label Six Gun Records. In 2011, the American band One Direction released a music video titled “2012.”
One Direction’s second album, “Take Me Home,” is set for release in the U.S. and Canada on November 13, 2012, and in other countries on November 12, 2012.
